ANALISIS KRITIKAN JASSER AUDA TERHADAP KAEDAH AL-NASKH

Abstract


There are various efforts by modern researchers and scholars which are aimed at introducing some kind of reformation (tajdīd) to various aspects related to uṣūl al-fiqh and maqāṣid. One of those leading contemporary reformation proponents in uṣūl al-fiqh today is Jasser Auda. This paper aims to analyse one of his proposals, which is related to the concept of al-naskh (abrogation). According to him, the principle of abrogation does not have any religious basis in the al-Qur’ān nor the Sunnah. It is instead in most situations a personal opinion of the narrator/comentator. As an alternative to alnaskh, his proposal is for the uṣūliyyūn to consider the maqāṣid (higher objectives) behind each verse (naṣṣ) in circumstances where there are disagreements between the verses (nuṣūṣ).
